    When should a startup hire its first HR person?

    Six signs that tell you more than headcount does, and what HR should look like at each stage from your first hire to 50 people.

    Every founder eventually asks the same question: when should we hire HR?

    The common answer is a number. Somewhere around 50 employees, the thinking goes, you hire your first HR manager. That is roughly right for a full-time HR hire. But it hides a more useful truth: you need HR judgement long before you need an HR department.

    Headcount is the wrong trigger

    Headcount tells you how big the team is. It doesn't tell you how much HR risk you're carrying.

    Take a 15-person team that has just raised funding, hires two people a month and has staff in three states. It needs far more HR support than a stable 30-person team that hasn't hired in a year.

    So instead of asking how many people you have, ask what is happening to your people right now.

    Six signs you need HR support now

    1. You've just raised funding. Investors will look at your contracts, IP assignments and compliance, if not now, then at the next round. Gaps that were harmless at 8 people become diligence issues at 25. The HR checklist after a raise sets out what to fix first.
    2. You're hiring more than one person a month. At this pace, offer letters, onboarding and paperwork start to slip. Inconsistent offers create problems that surface months later.
    3. You've crossed 10 employees. The POSH Act now requires an Internal Committee at each office, and interns, trainees and contract staff count towards the 10. ESI also starts at 10, the labour codes' rule on appointment letters applies once you have 10 or more workers, and PF follows at 20.
    4. You've had your first difficult exit. A resignation that turned messy, a termination or a dispute over notice or dues is often the moment founders realise how much depends on paperwork they never set up.
    5. Founders are spending real time on people admin. If a co-founder spends hours a week on leave queries, insurance claims or offer letters, that is expensive time taken away from product and customers.
    6. Managers are asking questions nobody can answer. Can we extend probation? What do we pay for leave on exit? Is this person a consultant or an employee? When the answers are guesses, risk builds quietly.
    If two or more of these apply, you need HR support, whatever your headcount.

    What HR looks like at each stage

    1 to 10 people: founder-led, with solid templates. Founders can handle HR themselves at this stage if the foundations are right. That means proper offer and appointment letters, IP assignment for everyone who builds your product, and a basic leave policy. It also covers the duties that begin with your first hire: shops and establishments registration or intimation as your state requires, professional tax where your state levies it, timely wage payment and a written POSH policy. A one-time set-up is usually enough.

    10 to 25 people: fractional HR. Hiring speeds up, more obligations arrive (the POSH committee, ESI and appointment letters at 10, PF at 20) and the first people issues appear. You need an experienced HR partner for a few hours a week, not a full-time hire. A fractional HR business partner sets up policies, onboarding and insurance, and is on call when something difficult happens.

    25 to 50 people: fractional HR, with more depth. Now you need regular rhythms: performance reviews, salary revisions, manager support and -ready records. A fractional partner can run these, sometimes alongside a junior HR executive who handles day-to-day operations.

    50 and beyond: your first in-house HR lead. This is when a full-time HR leader pays for themselves. If the foundations were built well, they inherit working systems instead of a clean-up project.

    The mistake founders make with the first HR hire

    When founders finally hire, many pick someone too junior. An HR executive can run processes well. But they may not have the judgement to handle a sensitive exit, design a compensation structure or advise a founder who is struggling with a co-founder relationship.

    Others hire someone too senior, too early: a head of HR at 20 people who has no team and spends their time on admin.

    A fractional HR business partner avoids both mistakes. You get senior judgement for the decisions that need it, and structured operations for everything else, at a fraction of the cost of a full-time leader.

    Three questions to answer this month

    If you're not sure where you stand, start here:

    • Does every employee and contractor have a signed contract with an IP assignment clause?
    • Do you know which statutory registrations and policies apply to your team today?
    • If someone resigned tomorrow, would you know exactly what to pay them and what to recover?

    If any answer is "not sure", it's time to bring in HR help. It doesn't have to be a full-time hire. It does have to be someone who knows what they're doing.
